Conditions of entry

1. Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of entry.

2. Entry to the promotion is open to all Australian and New Zealand residents aged 18 years and over who fulfill the entry requirements and are able to take the major prize on the specified dates (see clause 10). Directors, managers, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this promotion are ineligible. "Immediate families" means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.

3. The promotion begins at 9:00am on 28/11/2009 for Victorian residents, 9:00am on 05/11/2009 for South Australian Residents and 9:00am on 04/11/2009 for all other states and territories. The promotion closes 11.59pm on 30/06/2010 (AEDT) ("Promotion Period"). All times Melbourne times.

(a) To enter, consumers must purchase any of the following Hygain products Hygain 3 in 1, Hygain Allrounder, Hygain Balanced, Hygain Equine Senior, Hygain Grand Prix, Hygain Grotorque, Hygain Honey B, Hygain Ice, Hygain Micrspeed, Hygain Powatorque, Hygain Prodigy, Hygain Racetorque, Hygain Release, Hygain Showtorque, Hygain Studtorque, Hygain Sprint Lane, Hygain Tracktorque or Hygain Zero. ("Product") during the Promotion Period.
(b) Eligble entrants must then cut the Hygain Champions token logo from the side of the bag and return it along with their name, address, phone number and email address to:

(c) Each original token logo received by the Promoter counts as one entry in the draw for the major prize. Multiple entries are allowed. Multiple token logos may be sent in the one envelope. Facsimiles or photocopies of logos are not acceptable. Only original Champions Club tokens from a Hygain feed bag are acceptable.
(d) Entries not fully complying with these conditions of entry will be deemed invalid. Sharing purchase receipts or any other use of third party purchase receipts is not allowed. If the Promoter reasonably believes that an entry has been made on this basis, the Promoter will invalidate all entries affected.
(e) Entries must be received by the promoter within the Promotional Period. The promoter accepts no responsibility or liability for late, lost, incomplete, incorrectly submitted, illegible or corrupted entries, claims or correspondence whether due to error, omission, alteration, tampering, destruction, deletion, theft or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
(f) The major prize draw will be conducted at Hy Gain Feeds Pty Ltd, 10 Hickson Road Officer Vic 3809.
(g) The draw will be conducted at noon (Melbourne time) on 01/07/2010. All entries received within the Promotion Period will be entered into the draw.
(h) Retain purchase receipts to validate all entries as photocopies of such receipts will be required in order to redeem prize.

Major Prize

5.

There is one major prize to be awarded. The first valid entry randomly drawn will win the major prize.
(a) The major prize is a trip for two to the 2010 Alltech FEI World Equestrian Games in Lexington, Kentucky USA and comprises:

  • Two return economy airfares to Lexington Kentucky USA from the winner's nearest Australian capital city international airport or for New Zealand winner from Auckland international airport.
  • 5 nights' twin share accommodation at a venue as nominated by the Promoter.
  • Airport transfers within the USA.
  • Two reserve seat tickets to four scheduled events selected by the Promoter and two general admission tickets for each of the five days of the Games. Tickets are only valid for the scheduled events and scheduled days and are non-transferable or redeemable for cash.

(b) The major prize is valued at up to AU$12,000.00 (inc GST) depending upon the winner's location of residence.
(c) Major prize must be taken 29/09/2010 - 07/10/2010.
(d) Major prize is subject to booking and flight availability which is not the responsibility of the Promoter, and must be taken on the dates specified by the Promoter: No extension will be permitted. Any alterations to confirmed major prize details will be at the expense of the winner and will be subject to the prior written approval of the Promoter.
(e) The winner and companion taking the major prize must depart and return at the same time using the same air carrier and sharing the accommodation. The winner is responsible for ensuring that all necessary documentation to travel is obtained, and the Promoter accepts no responsibility for same.
(f) It will be the responsibility of the winner and companion to arrange their own entry visa to the United States of America. The Promoter accepts no responsibility with regard to guarantee of entry to the United States or exit from Australia New Zealand. Failure of the prize winner to obtain approval for travel to the United States of America will result in total forfeiture of the major prize.
(g) All additional spending money, additional meals, taxes, insurance and all other ancillary costs, including any costs associated with passports/visas and costs associated with transport etc from the winner's and companion's place or places of residence to the departure airport are the responsibility of the winner.
(h) In the event that one of the people participating or nominated to participate in the major prize is under 18 years of age, a parent or legal guardian of the participant must be present for the duration of the redemption of the major prize either as winner or at their own expense.
(i) Each participant is required to sign a disclaimer and indemnity in a form approved by the Promoter in favour of the Promoter and all involved parties prior to participating. If they do not sign that disclaimer and indemnity form, they will not be entitled to participate.

Instant Win Prizes.

6. During the Promotional Period selected bags of Hygain feed will carry an instant win prize comprising of Hygain merchandise or a product voucher for another bag of Hygain feed the same as the purchased feed product. As the instant win prize is included in the product packaging and there is no claim process there is no unclaimed prize process for the instant win prize component of the competition.

Total value of merchandise and voucher prize pool is AUD$64,734.00 (Recommended Retail Price including GST).

7. Total maximum prize pool for this promotion is up to AUD$76,734.00 (Recommended Retail Price including GST). The Promoter accepts no responsibility for any variation in prize value.

8. The Promoter reserves the right in its sole discretion to disqualify any entrant who tampers with the entry process. In the case of a dispute the decision of The Promoter or its representative will be final.

9. If a winning entry of the major prize is deemed not to comply with the terms and conditions of the promotion, the entry will be discarded and a new major prize winner will be drawn. The Promoter's decision is final and no correspondence will be entered into.

10. Prizes are not transferrable or exchangeable and cannot be redeemed for cash, prizes or products, or any other form of compensation. If for any reason the major prize winner or their travelling companion are unable to take any part of their prize at the time of it's provision by the Promoter, then that part of the prize will be forfeited and no compensation will be provided in lieu of that part of the prize.

11. If for any reason a prize or a part of the major prize is unavailable the Promoter reserves the right to substitute another item, at it's sole discretion, of equal or greater value, subject to the approval of the relevant gaming authorities, where required.

12. At The Promoters request, the winner of the major prize and their travelling companion must participate in all promotional activity, such as publicity and photography associated with the winning of the major prize without further compensation or payment. They must also consent to the use of their name and image in promotional material.

13. The name of the winner of the major prize will be published on the Hygain website: www.hygain.com.au on Thursday July 1 2010. The winner will be officially notified by registered mail and phone. The winner will also be published in the public notices of Australian Newspaper on Saturday July 3 2010.

14. Due to booking and travel documentation requirements and in the event the promoter is unable to contact the major prize winner within 28 days of the major prize draw. The major prize will be forfeited and the promoter reserves the right to redraw the major prize from the entries held at noon ( Melbourne time ) on Thursday 29th of July 2010. The redraw will be conducted at Hy Gain Feeds Pty Ltd, 10 Hickson Road Officer Vic 3809. All entries received within the Promotion Period will be re-entered into the draw.

15. The Promoter may require a winner to provide proof of identity, age and or residency and or compliance with other eligibility or entry criteria. Identification considered suitable for proof is at the Promoters discretion.

16. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of cancellation, postponement, transfer or any cause beyond the control of the Promoter, the Promoter may at it's sole discretion cancel, terminate, modify or suspend, the promotion subject only to the approval of the relevant gaming authorities, where required.

17. The Promoter, it's associated agencies and companies and the agencies and companies associated with this promotion will not be liable for any loss ( including, without limitation, indirect, special or consequential loss or loss of profits ), expense, damage, personal injury or death which is suffered or sustained ( whether or not arising from any person's negligence ) by any person in connection with this promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

18. The Promoter accepts no responsibility for any tax implications arising from prize winnings in this promotion. Independent financial advice should be sought. Where the operation of the promotion results in the supplies being made not for monetary consideration, entrants agree to abide by the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.

19. All entries are the property of the Promoter. The information provided by the entrants will be used by Hy Gain Feeds Pty. Ltd for the purposes of conducting this promotion. The Promoter may on request provide this information to State and Territory Lottery agencies as required under legislation.
